Backing Tracks

DIGITAL DELIVERY (Downloading):
4th Beat Music supply tracks for downloading in mp3 format.
Passwords to access the download area will be valid for 3 days from the time of purchase and 3 downloads per item.
Passwords cannot be re-activated after this period has expired. Customers who fail to downloaded purchases within this period will be required to re-order again at the prices set out in our price list.

TERMS OF SALE:
4th Beat Music cannot be responsible for malfunction of your equipment due to the use of any of our MP3's or CD's.
Due to the nature of Digital downloads and the Licence, once purchased, the license cannot be cancelled by licensee.
You do not have a right to withdraw from a purchase on the 4thbeat Store once delivery of the Products has started.

The 4thbeat Store service commences immediately when you begin to download Products from the 4thbeat Store and you will not have a right to cancel your contract once the service commences.
We are unable to accept any backing tracks returned
for credit or exchange unless supplied in error by 4th Beat Music.
All songs come with demos, therefore you are encouraged to listen to them before you buy. Under these terms of sale we cannot issue refunds.
All Cd's are dispatches within 24hrs of purchase.
All goods are checked before leaving our premises, if however goods arrive damaged in any way, we will provide full replacements if proved to be our negligence. We are unable to rectify any discrepancies to orders unless reported to us within 7 working days of receipt.
Damaged goods will only be exchanged with identical items.

COPYRIGHTS, TRADEMARKS and Other Proprietary Rights:
All written content on this site is the property of 4th Beat Music.
All MP3 content is subject to the appropriate copyright, trademark or other intellectual property laws.
You may use the MP3 content only for your personal use.
You must keep intact all copyright, trademark or other proprietary notices or marks.
You may not copy or reproduce any content obtained from this site or copy or reproduce any backing tracks purchased from 4th Beat Music.
You agree not to alter, modify, publish, distribute, sell, broadcast,transmit, create derivative works from, or edit any content of this site or backing tracks purchased from 4th Beat Music without the expressed written permission of 4th Beat Music and/or any appropriate third parties.
Any copyright infringement will result in termination of service and possible legal action.

Privacy Policy
4th Beat Music may from time to time send relevant information through e-mail. We do not share e-mail addresses with any third party. You may request removal at any time. This complies with the Data Protection Act.
We reserve the right to modify our terms and conditions at any time, and will post all modifications on our terms and conditions section of the site.

What is a Copyright?
Copyright is a protection that covers published and unpublished literary, scientific and artistic works, whatever the form of expression, provided such works are fixed in a tangible or material form. This means that if you can see it, hear it and/or touch it - it may be protected. If it is an essay, if it is a play, if it is a song, if it is a funky original dance move, if it is a photograph, HTML coding or a computer graphic that can be set on paper, recorded on tape or saved to a hard drive, it may be protected. Copyright laws grant the creator the exclusive right to reproduce, prepare derivative works, distribute, perform and display the work publicly. Exclusive means only the creator of such work, not anybody who has access to it and decides to grab it.

Use of any website owned by 4th Beat Music is entirely any your own risk.
No content of any of 4th Beat Music sites may be copied or used without written permission.
Buy using these sites you agree to hold harmless 4th Beat Music from anything that may arise from its use.

ARTISTES:
The artistes are in no way associated with 4th Beat Music.
All artiste's names are used solely for identification there songs.

SONG REMOVAL:
On occasion, we may have to remove certain songs from our catalogue.
This is done at our discretion.

MP3s:
We pay MCPS/PRS(JOL) fees on all tracks that are sold. As a result all recorded works by 4thBeat Studios & third parties are subject to MCPS/PRS(JOL) fees.
Special Licenses can be issued to anyone wishing to record MP3's for demos or any other application.

POPSTARS

All cancellations for POPSTARS Studio time MUST be received no later than 7days before booked session or a cancellation fee of £25+VAT will apply.

All Popstars Gift Certificates are valid for a 6 month period unless otherwise stated.
And must be redeemed within this time frame.
Popstars are free to book a recording session which suits both parties within this period however, sessions booked within the last 2 weeks are subject to studio availability.
Any Backing Tracks that are supplied by 4thBeat must be chosen no later than 2 weeks before sessions can be booked.

Each Gift certificate has free Backing Tracks to the amount the package needs i.e
POPSTARS 1 = 1 free Backing Track
POPSTARS 2 = 2 free Backing Tracks
Additional tracks can be purchaced from our website at the standard rate.
POPSTARS are free to use their own Backing Tracks if they so wish.

POPSTARS Gift certificates are not refundable but can be used by any 3rd party.

Time extentions can be purchased at a cost of £25 +VAT and are valid for 8 weeks.

Extentions must be purchased within 14 days of the original certificate expiry date.

Notice of a client's intent to cancel a recording session must be received by 4thBeat no later than 7 days before such session. If notice is not received by 4thBeat, the client shall be liable for the cost of one half of the time booked.

Sessions cancelled the same day of the scheduled session will be liable for the total cost of the booked time.

The whole amount of unused time booked will be charged to the client irrespective of client's failure to arrive for a session on time or in the event that the client must leave the session early, or if the session is completed before the booked time has expired. Payment in full for materials and fees is due and payable immediately following each session. 4thBeat reserves the right to make other financial arrangements with its clients. Client(s) will pay all 4thBeat's lawyer's fees associated with financial collection processes for services rendered by 4thBeat or materials purchased.

No recording tapes in 4thBeat's possession shall be released to clients until all open accounts have been settled and all checks tendered as payment have cleared 4thBeat's account.

Clients assume all risks associated with storing, on the premises of 4thBeat, any and all sound recordings, video recordings, or equipment of any kind or nature and shall hold 4thBeat harmless from any and all damage that might occur to said articles for any reason. In any event, 4thBeat's liability shall be limited to the replacement cost of an unrecorded tape of comparable value.

4thBeat's liability with respect to "downtime" of any and all studio sessions as a result from equipment malfunction or availability, personnel, hired musicians, acts of nature or public utility companies, etc., shall be limited solely to the studio time of such booked session; and client(s) agree to hold 4thBeat harmless from any and all damages from such "downtime". 4thBeat makes no warranties either express or implied other than those contained herein. 4thBeat shall not be liable for unforeseen of consequential damages of any kind. Should 4thBeat be unable to conduct a booked session for any reason, and then 4thBeat warrants that it shall re-book such cancelled booking at another time that is mutually available to 4thBeat and the client. Rates, policies, and equipment may change without displayed, written or verbal notice.

A deposit will be required to confirm all studio bookings. Such deposit shall be equal to 30% of the cost of the total time booked or £40 per 10 hour day.

Deposit must be received two weeks prior to session or 48 hour after the booking has been made.

4thBeat reserves the right to waive such deposit requirement in its unfettered discretion. Studio bookings for which no deposit has been received by 4thBeat shall be subject to change or cancellation should management so decide, without notice to client.

If recording for more than one non-subsequent day, the appropriate number of DAT disks or CDs will be required for the storage of material in progress.

Do allow enough time during the session to check each final mix all the way through once it has been mastered to DAT or CD so that you are certain each track has been recorded to your satisfaction before you leave the studio. If there is a problem or you are unsatisfied with any aspect of the mix, you have a chance to re-record it while the desk and outboard gear is set-up.

4thBeat cannot accept responsibility for recorded media once it has left the studio. We recommend that all clients make back-up copies of everything they do, and store relevant disks and tapes appropriately.
